EPL Benjamin Mendy

"The matter is subject to a legal process and the club is therefore unable to make further comment until that process is complete"

I think some should follow the same approach.

Can’t understand if we shouldn’t judge which we shouldn’t, how comes he’s remanded when worse have been given bail with restrictions, and if your comment was in response to mine, I’ve just repeated what’s been reported in the press apart from the personal comment of “ dirty bastard “

The overriding reason why people aren't bailed is the risk of noncompliance or the likelihood of further offences being committed. I have no idea on the circumstances of the allegations, and wouldn't be judging either way if I did. But the seriousness of the charges are very different from whether there is further risk or not.

And yes, it is the personal comments I was referring to.

Ah well the personal comments will intensify if he’s found guilty and to be remanded then the COS must feel they have a rock solid case against Mendy

Mendy is a foreign national with the resources to leave this country. He's also high profile and could face repercussions from others after the offences were made public. These are the factors that would have been used when determining bail, and nothing to do with a "rock solid case".

"If found guilty" is the key point regarding comments. There are many things wrong with the criminal justice system, but the presumption of innocence until proven guilty is the one thing none of us should ever forget.

Quite agree regarding innoncent until proven guilty, but with that I will open another debate, the anonymity of the accused, he should be anonymous until proven guilty and if found guilty the anonymity ceases and then a time frame of say maybe one year for any other potential victims
to be allowed to come forward and make a complaint to the police and if there was another case or cases then a new trial to be held with the accused being told when the original sentence he received for the first crime could and would be enhanced accordingly.

He was remanded by the Police overnight to appear before the Magistrates tomorrow - not the same as being remanded - highly likely to be granted conditional bail tomorrow

The Police regularly keep people in custody for court only for them to be released on bail the next day or after a JIC at the Crown Court - you are jumping too far ahead here

This is what I read on the BBC web hasn’t realised it was tomorrow.

Mr Mendy, of Prestbury, has been remanded in custody and will appear at Chester Magistrates' Court on Friday.

Ok hadn’t read that just remanded in custody
The Press are never very good at making these things clear - its not as headline making to say remanded overnight as to imply he is already banged up - still I guess a night in police custody won't be much fun to a man used to the high life

There’s a lot of slightly muddled legal information/thinking on this thread!

That’s not entirely true. When the court makes a decision on bail (which doesn’t seem to have happened yet) they can have a regard to the strength of the evidence, if they’re considering refusing bail under the likelihood of the defendant failing to surrender, committing further offences etc

Yes but the fact that he has been charged and remanded rather than released under investigation or released on police bail at least implies (but doesn’t guarantee, given the other factors in this case such as his celebrity status) that they have quite good evidence on him - enough for the CPS to agree to a charge.
